Terms and Conditions

From time to time we will make changes to these terms and conditions.  If the changes to these terms and conditions are material and will significantly impact you, we will notify you of the changes by reasonable means which may include emailing you in addition to posting the changes on the Program’s webpage.  If you have any queries or concerns in relation to our terms and conditions, please contact us at tryiton@tryathlonfoundation.co.nz

    1. In consideration of allowing my child (Child) to participate in the TRY it On online fundraising programme (Programme) forming part of the Sanitarium Weet-Bix Kids TRYathlon 2020/2021 series, I acknowledge that on my own behalf and on behalf of the Child participating in the Programme that my Child will participate in the Programme on these terms and conditions. If I do not consent to these terms and conditions, I will not sign up my Child for the Programme.
    1. I agree not to procure that my Child does not do anything which may adversely affect, prejudice or bring into disrepute the reputation of the Foundation and the Programme.
    1. I represent and warrant that I am a parent or legal guardian of my Child and have the authority to bind myself and my Child to these terms and conditions. If you have any concerns whatsoever about your Child’s use of this website and your Child’s participation in the Programme, please notify us immediately by emailing us at tryiton@tryathlonfoundation.co.nz or alternatively telephoning us on 0800 9338 249
    1. The Programme is an online fundraising platform that allows your Child to set up your Child’s page for the purposes of raising donations on behalf of the Foundation to assist other underprivileged Kiwi kids to participate in the Tryathlon (Charitable Purpose).
    1. If you and or your Child have set up your Child’s page, you authorise us to collect donations from persons who choose to make a donation and pass on the donation to the Foundation to be used for the Charitable Purpose.
    1. By signing up with the Programme you agree:
      1. to comply with these terms and conditions and our Privacy Policy
      2. to provide us with true and accurate information as reasonably requested by us to conduct the Programme, including as part of the signing up process for establishing your Child’s page maintained by us to record any amounts donated, when creating Child’s page and when providing information to us for verification purposes;
      3. not to upload any content (including text, pictures, graphics, audio, video, images or other data) on Child’s page which breaches the intellectual property rights of any third person or entity;
      4. not to engage in any conduct in relation to the services that violates laws (including privacy laws), rules, regulations or these terms and conditions;
      5. not to upload on Child’s page any content that we reasonably believe:
        1. infringes any intellectual property rights of any third party;
        2. detrimentally affects the brand or reputation of the Foundation and the Programme, any other user or any affiliates or partners of the Foundation;
        3. misleads as to the nature, type, service, intentions or benefits of donating to the Foundation via the Programme;
        4. contains inaccurate, ambiguous, exaggerated, defamatory, untrue or out-of-date information;
        5. encourages, counsels, incites or suggests any criminal or unlawful acts;
        6. preys on individual groups by virtue of their circumstances;
        7. contains vulgar and/or suggestive language or images or innuendo or slang of a sexual, immoral, racial or violent nature;
        8. promotes or provides inflammatory or demeaning opinions of an individual or group;
        9. uses images or information of a named or identifiable third party without their consent (parental/guardian consent is required if the third party is under 18 years);
        10. misrepresents Child’s identity or affiliation with any other person or organisation;
        11. uses the Programme webpage to send junk mail or “spam” in breach of the Unsolicited Electronic Messages Act 2007;
        12. conducts, displays or forwards surveys, raffles, lotteries, contests, pyramid schemes, chain letters or the like;
        13. uses the Programme webpage to facilitate product or event ticket sales;
        14. uses the Programme website in a way that will result in the Donor receiving a material benefit in respect of the Programme pages that are eligible for a tax credit;
        15. interferes with or disrupts the Programme service or services or networks connected with Programme, or introduces any computer virus which may be harmful to Our system;
        16. is harmful and/or offensive; or
        17. provide a donor with any gift, prize or any other form of incentive in connection with the making of a donation by a donor.

We do not actively and/or continuously moderate Child’s page but reserves right to remove or edit any content posted on the Child’s page at it sole discretion and without notice, regardless or whether or not it is, in the opinion of any third party, in breach of these terms and conditions.

    1. Passwords & security
      1. You are responsible for keeping personal login information safe, private and secure at all times. We may take such security measures as we deem fit, including suspending or locking your Child’s account or your Child’s page if we suspect any malicious activity or unauthorised access.
    1. Credit Card payments 
      1. Any donation or other transactions made through the Programme’s webpage by a donor inserting that donor’s credit card details is final and not disputable. Where there has been an unauthorised use of a donor’s credit card, and the unauthorised nature of that use is proved on the balance of probabilities, then the donation will be refunded unless it has already been credited to the Foundation.
    1. Refunds
      1. We collect donations on behalf of the Foundation and pass the money to the Foundation every 14 days. We will process refund requests if received in writing within 48 hours of the initial transaction.
      2. We cannot process refunds on behalf of the Foundation once the funds have been settled to the Foundation. Please contact support on 0800 9338 249 or tryiton@tryathlonfoundation.co.nzdirectly quoting your Programme donation reference number.
    1. Receipts
      1. Donors are automatically emailed a receipt (or notice of successful payment) for every donation made to the Programme.
    1. Termination or suspension
      1. We may reject your Child’s registration, your Child’s page creation, use of or access to our services at our discretion.  
      2. We may suspend or terminate your Child’s page and/or use of our services without incurring any liability to you if:
        1. a serious complaint is received or a number of complaints (amounting to what we determine as a serious complaint) are received about you in relation to your use of our services;
        2. you breach these terms and conditions, our Code of Conduct;
        3. We consider your behaviour to be unacceptable;
        4. We consider your activity is detrimental to, or may cause distress or harm to, any person;
        5. in relation to suspension only, such suspension is necessary for any system maintenance (after giving you as much advance notice as is reasonably practical in the circumstances) or to address security concerns in relation to Our systems;
        6. termination or suspension is required by any law or direction from any government, law enforcement or other authority; or
        7. We are unable to complete our verification processes (including any required re-verification).
    1. Privacy
      1. We take privacy seriously when we collect personal information from You and donors.
      2. When you register, you agree to our Privacy Policy. You can find our Privacy Policy here.
    1. Individual Donor responsibility
      1. Donors may donate to the Foundation via the Programme webpages as they see fit and donors are solely responsible for their decisions to make a donation.
    1. Jurisdiction
      1. New Zealand law applies to these terms and conditions.
